Terms and Conditions

Welcome to the website of the Asia-Pacific Broadcasting Union (“ABU”, “we”, “us”, or “our”). By accessing or using our website, member portal, applications, or related services (collectively, the “Service”), you agree to be bound by these Terms and Conditions (the “Terms”). Please read them carefully. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By creating an account, registering for an event, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms together with our Privacy Policy. These Terms apply to all users including ABU members, public registrants attending events, visitors, and contributors.

2. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to create an account. If you are under that age, you may use the Service only with the consent and supervision of a parent or legal guardian. By using the Service you represent that all information you provide is accurate and truthful.

3. Account Registration

To access certain features (event registration, member portal) you may be required to create an account. You agree to:

  • Provide accurate, current and complete information during registration.
  • Maintain the confidentiality of your password and account credentials.
  • Promptly update any information that becomes inaccurate or outdated.
  • Notify us immediately at info@abu.org.my of any unauthorised use of your account.

You are responsible for all activities that occur under your account. ABU is not liable for any loss or damage arising from your failure to safeguard your credentials.

4. Membership and Event Registration

ABU offers different categories of membership (Full Member, Associate Member, Affiliate Member, etc.) governed by ABU’s constitution and admission rules. Membership applications are subject to approval by the ABU Secretariat and the Administrative Council.

Public users may register for designated ABU events without becoming members. Event registrations may be subject to capacity limits, fees, refund rules, and additional terms specified on the event page. ABU reserves the right to refuse registration or cancel an event at its discretion.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Upload, post or transmit any content that is defamatory, harassing, obscene, infringing, or otherwise objectionable.
  • Interfere with the operation of the Service, including by introducing viruses, malware, or other harmful code.
  • Attempt to gain unauthorised access to any portion of the Service, other accounts, or our infrastructure.
  • Scrape, crawl, harvest, or index any portion of the Service without our prior written consent.
  • Use the Service to send unsolicited communications, promotions, or advertisements.

6. User-Generated Content

The Service may allow you to submit content such as forum posts, replies, comments, profile information, and uploaded files (“User Content”). You retain ownership of your User Content but grant ABU a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify (for formatting), publish, and display the User Content within the Service for the purpose of operating and promoting ABU activities.

You are solely responsible for your User Content and represent that you have all necessary rights to submit it. ABU reserves the right (but is not obligated) to review, moderate, edit, or remove any User Content at its discretion. Forum content from members may require admin approval before being published.

7. Intellectual Property

Except for User Content, all content on the Service — including text, graphics, logos, images, videos, software, and the ABU name — is owned by ABU or its licensors and is protected by copyright, trademark, and other laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

8. Third-Party Services and Links

The Service may contain links to or integrate with third-party websites and services (e.g. payment gateways, identity providers, social-media plugins). ABU does not control these third-party services and is not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to those parties’ own terms.

9. Fees and Payments

Some events, memberships, or services may require payment of fees. All fees are payable in the currency specified at the point of registration. Unless expressly stated, fees are non-refundable. Payment processing is performed by third-party payment providers and is governed by their respective terms.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect personal information. By using the Service you consent to that collection and use.

11. Termination

We may suspend or terminate your account or access to the Service at any time, with or without notice, if we believe you have breached these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will survive.

12. Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, express or implied. ABU does not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, ABU and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of or inability to use the Service. Our total aggregate liability shall not exceed the fees you have paid to ABU in the twelve months preceding the event giving rise to the claim, or USD 100, whichever is greater.

14. Indemnification

You agree to indemnify and hold harmless ABU and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, or your breach of these Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict-of-law provisions. Any dispute arising out of or in connection with these Terms shall first be addressed through good-faith negotiation. If unresolved within sixty (60) days, the parties shall attempt mediation by a mutually agreed mediator before pursuing any other remedy. The courts of Kuala Lumpur, Malaysia shall have exclusive jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last Updated” date. Material changes will be communicated where reasonably practicable. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
